Welcome to JShop.co.za ("JShop", "we", "our", or "us"). These Terms and Conditions govern the use of our online marketplace and apply to all visitors, buyers, sellers, and users of the website. By accessing or using JShop.co.za, you agree to be bound by these Terms.

01. About JShop

JShop is an online marketplace operated from Mossel Bay, South Africa, that connects buyers with independent sellers.

JShop provides the online platform, payment processing, and administrative services required to facilitate transactions between buyers and sellers. JShop is not the owner, manufacturer, importer, or supplier of the products listed unless specifically stated.

02. Eligibility

You must be at least 18 years old or have the permission of a legal guardian to use the website.

By registering an account you warrant that:

  • the information you provide is accurate;
  • you are legally capable of entering into binding agreements;
  • you will comply with all applicable South African laws.

03. Seller Accounts

Sellers may list products for sale on JShop subject to approval. By creating a seller account you agree that:

  • all products listed are legal to sell in South Africa;
  • all product information is accurate and truthful;
  • photographs accurately represent the products;
  • prices are correct and products are available for sale;
  • you own the products or are authorised to sell them.

JShop reserves the right to remove listings or suspend seller accounts at its discretion.

04. Product Listings

Sellers are solely responsible for:

  • product descriptions, pricing, and images;
  • stock availability and warranties (where applicable);
  • compliance with applicable legislation.

JShop does not verify the accuracy of listings and cannot guarantee that listings are error-free.

05. Orders

Once payment has been successfully received from a buyer, the seller is legally responsible for fulfilling the order.

Sellers agree to:

  • prepare the order promptly;
  • dispatch the order within the stated handling period;
  • package products appropriately to prevent damage;
  • use the delivery method selected for the order;
  • provide tracking information where available;
  • communicate with buyers regarding any unexpected delays.

Failure to dispatch orders within the required timeframe may result in:

  • delayed seller payouts;
  • cancellation of the order;
  • negative performance records;
  • temporary suspension of selling privileges; or
  • permanent removal from the JShop marketplace.

Repeated late dispatches or failure to fulfil customer orders may result in immediate termination of the seller account without compensation for future lost sales.

06. Payments

Payments are securely processed through the payment gateway integrated into JShop. JShop collects payment on behalf of the seller.

The seller authorises JShop to:

  • receive payment from buyers;
  • deduct the applicable commission and fees;
  • pay the remaining balance to the seller once the order has been successfully completed.

07. Seller Commission

JShop charges a commission equal to 10% of the final product selling price only.

No commission is charged on delivery fees.

Example:

  • Product Price: R500.00
  • Delivery Fee: R100.00
  • Total Paid by Buyer: R600.00
  • JShop Commission (10%): R50.00
  • Seller Receives: R550.00

The seller authorises JShop to automatically deduct the applicable commission before any payout is made.

JShop may amend its commission structure in future by providing reasonable notice to sellers through the website or seller dashboard.

08. Seller Payouts

Seller payouts are processed once all of the following conditions have been met:

  • the order has been delivered;
  • delivery has been confirmed through the courier or buyer;
  • at least forty-eight (48) hours have passed following confirmed delivery; and
  • no dispute, complaint, refund request or fraud investigation is outstanding.

Seller payments are processed every Friday.

If an order becomes eligible after the weekly payment run has already been completed, payment will be included in the following Friday's payout cycle.

Example:

If an order is confirmed as delivered on Thursday afternoon, the mandatory 48-hour holding period has not yet expired before Friday's payout run. That order will therefore be paid on the following Friday.

Seller payouts are made only to the bank account recorded in the seller dashboard.

Sellers are solely responsible for ensuring that their banking information remains accurate and up to date.

JShop accepts no responsibility for delays caused by incorrect banking information supplied by the seller.

Funds held during the payout waiting period remain the property of the seller, however no interest or other compensation shall accrue on held funds.

09. Delivery

Sellers are entirely responsible for fulfilling and delivering all orders placed through JShop.

Seller responsibilities include, but are not limited to:

  • setting their own delivery prices;
  • selecting their preferred courier or delivery provider;
  • packaging products safely;
  • dispatching orders on time;
  • ensuring products reach buyers in good condition;
  • providing tracking information where available;
  • resolving delivery issues with their chosen courier.

JShop does not perform deliveries and accepts no responsibility for:

  • delayed deliveries;
  • lost parcels;
  • damaged parcels;
  • courier negligence;
  • failed delivery attempts;
  • incorrect delivery addresses supplied by buyers.

Sellers remain fully responsible until the buyer has successfully received the product.

10. Delivery Fees

Sellers determine their own delivery charges when listing products.

JShop does not calculate, modify or guarantee delivery prices.

Sellers are responsible for ensuring that delivery charges accurately reflect their shipping costs.

Any loss arising from incorrectly configured delivery charges remains the seller's responsibility.

11. Buyer Responsibilities

Buyers agree to:

  • provide accurate delivery information;
  • make payment using approved payment methods;
  • inspect goods upon delivery;
  • report any issues within a reasonable time.

12. Returns & Refunds

Returns are handled in accordance with applicable South African consumer protection legislation and JShop's Returns Policy.

Where a buyer returns a product, the buyer is initially responsible for the cost of returning the goods unless otherwise required by law.

If the returned product is found to be:

  • defective;
  • materially different from its description;
  • incorrect;
  • damaged before delivery; or
  • otherwise supplied in breach of applicable consumer protection laws,

the seller agrees to reimburse the buyer for the reasonable return delivery costs.

Sellers who refuse to reimburse legitimate return delivery costs or who repeatedly fail to comply with their legal obligations may have their seller accounts immediately suspended or permanently removed from JShop.

JShop reserves the right to recover any approved refund or reimbursement from future seller payouts where necessary.

13. Prohibited Products

Sellers may not list illegal goods, counterfeit products, stolen goods, dangerous goods prohibited by law, firearms or ammunition unless legally permitted, drugs or controlled substances, offensive or unlawful material, or any product prohibited by JShop.

JShop reserves the right to remove prohibited listings immediately.

14. Intellectual Property

Users may only upload content they own or have permission to use.

By uploading images or descriptions, sellers grant JShop a non-exclusive licence to display and market those products on the website and associated marketing channels.

15. User Conduct

Users may not commit fraud, interfere with website operation, upload malicious software, impersonate another person, misuse the marketplace, or manipulate reviews or ratings.

Accounts may be suspended or terminated without notice for violations.

16. Limitation of Liability

To the maximum extent permitted by South African law, JShop shall not be liable for product defects, inaccurate listings, courier delays, lost or damaged parcels, indirect or consequential losses, loss of profits, or business interruption.

JShop's liability shall, where permitted by law, be limited to the amount of commission received for the transaction giving rise to the claim.

17. Indemnity

Sellers agree to indemnify and hold JShop harmless against any claims, damages, legal costs, or liabilities arising from products sold, inaccurate listings, intellectual property infringement, breach of these Terms, or failure to comply with applicable laws.

18. Privacy

Personal information is processed in accordance with South Africa's Protection of Personal Information Act (POPIA).

By using the website you consent to the collection and processing of your information as described in our Privacy Policy.

19. Website Availability

Although JShop strives for continuous availability, we do not guarantee uninterrupted access.

We may suspend access for maintenance, upgrades, security, or unforeseen technical issues.

20. Fraud Prevention

JShop reserves the right to:

  • verify identities and request supporting documentation;
  • suspend transactions and cancel suspicious orders;
  • cooperate with law enforcement.

21. Changes to These Terms

JShop may amend these Terms and Conditions at any time. Updated Terms become effective upon publication on the website.

Continued use of the website constitutes acceptance of the updated Terms.

22. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the South African courts.

23. Seller Performance

JShop monitors seller performance to maintain a reliable marketplace.

Performance factors may include:

  • dispatch times;
  • order cancellations;
  • customer complaints;
  • return rates;
  • communication with buyers;
  • policy violations.

Sellers whose performance consistently falls below acceptable standards may receive warnings, temporary selling restrictions or permanent account removal.

24. Right to Withhold Payments

JShop reserves the right to temporarily withhold seller payouts where:

  • fraud is suspected;
  • a payment dispute exists;
  • delivery cannot be verified;
  • the seller breaches these Terms;
  • additional verification is required.

Payouts will be released once the matter has been resolved.

25. Independent Sellers

Sellers acknowledge that they operate as independent businesses.

JShop is not the seller of record, manufacturer, distributor or supplier of products listed by independent sellers unless expressly stated otherwise.

Sellers remain solely responsible for:

  • product quality;
  • product safety;
  • warranties;
  • statutory obligations;
  • taxes;
  • compliance with South African law.
